These terms are an agreement between you and Tomen LLC ("we"), an Idaho limited liability company in the United States, reachable at feedback@tomen.app. They cover Tomen, a local-first ebook reader. By using Tomen, you agree to them.
Tomen lets you read your own ebooks and comics on your device. The core reader is free to use. We grant you a personal, non-exclusive, non-transferable license to use the app in accordance with these terms.
Tomen does not host, sell, or provide books. You supply your own files. You are responsible for ensuring you have the right to use any file you add to Tomen, and for complying with applicable copyright law. Your files stay on your device — or, if you connect your own storage (such as Dropbox) or your own book catalog, in that storage, under your control. Tomen's servers never receive your book files. If you use cloud sync, some of your reading data (positions, highlights, notes and settings) is stored on our backend so your devices stay in step; our Privacy Policy sets out exactly what does and does not leave your device.
Tomen Plus is an optional upgrade that unlocks premium features. It is a one-time purchase of a perpetual license — buy once, use it on any device where Tomen runs, with no recurring subscription. New accounts get a free trial of Plus, no card required. The specific features included may change over time as Tomen develops; we won't remove core features you've paid for.
Purchases are sold and processed by Polar, our merchant of record. Completing a purchase is also subject to Polar's terms. Your license is tied to the email account you use, which lets it follow you across devices.
Pricing is shown at checkout. Because Polar is the merchant of record, your purchase, billing, taxes, and refunds are handled under Polar's policies and applicable consumer law. See our Refunds page for a summary and how to request one.
You agree not to: misuse or interfere with the app or our backend; attempt to circumvent license checks or access premium features without paying; reverse engineer the app except where that right can't be legally restricted; or use Tomen for unlawful purposes, including infringing others' copyrights.
Tomen — including the app, its name, the "T" mark, and its design — is owned by us and protected by intellectual-property laws. These terms don't grant you rights to our branding. Third-party components are used under their respective licenses (credited in the app's colophon).
Tomen is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or that it will read every file format perfectly. You are responsible for keeping your own backups of your library and data.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of Tomen. Our total liability for any claim relating to Tomen will not exceed the amount you paid us (if any) in the 12 months before the claim.
Tomen connects to third-party services for some features — dictionary and translation lookups, book covers and genres, sign-in, sync, payments, and, if you connect it, your own Dropbox or book catalog. We're not responsible for those services, and your use of them may be subject to their own terms. The full list, and what each receives, is in our Privacy Policy.
You may stop using Tomen at any time. We may suspend or end access if you materially breach these terms (for example, by abusing our backend or circumventing licensing). A validly purchased perpetual license remains yours except in cases of fraud, chargeback, or abuse. If your account is deleted, synced reading data on our backend is deleted with it; the data on your devices stays yours.
These terms are governed by the laws of the State of Idaho, United States, without regard to conflict-of-laws rules. Mandatory consumer-protection rights in your country of residence still apply.
We may update these terms as Tomen evolves; we'll update the date above and note significant changes in the app. Continued use after a change means you accept the updated terms.
